Tracy Morgan has taken action against Walmart, accusing the chain of super stores of being partially responsible in the car accident that left him severely injured.

According to the NY Post, Morgan's new lawsuit claims that Walmart allowed one of its drivers to operate his truck at an unacceptable level of exhaustion. Morgan, along with three other plaintiffs, is seeking an unspecified amount of damages.

The suit was filed in New Jersey, the location of the accident, and also alleges that the company allowed Kevin Roper to take on a 10-hour drive after being awake for more than 24 hours. It also asserts that Tracy sustained, "severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation.”
